Terms of Service

1. Acceptance of terms

By using this website, placing an order, or accepting delivery of equipment from DeskDodes, you confirm that you have read and agree to these terms.

Who can order

• You must be at least 18 years old
• You must be able to enter a binding contract
• If you're ordering for a business, you must have authority to commit that business

Power equipment is not sold to minors. We may decline or cancel an order where we have reason to believe this requirement isn't met.

2. What we sell

Product information

• We aim to describe every machine accurately, including deck width, engine and drive type
• Photographs are illustrative; the machine you receive may differ in finish or minor detail
• Manufacturers change specifications from time to time without notifying dealers in advance
• Where a specification matters to your purchase — a gate clearance, a slope rating — confirm it with us before ordering

3. Accounts

You can browse and buy without an account, but an account keeps your order history, machine serial numbers and warranty registrations in one place.

• Give accurate information when you register, and keep it current
• Keep your password to yourself; you're responsible for activity under your account
• Tell us straight away if you think someone else has accessed it
• We may suspend an account used for fraudulent orders

4. Orders and payment

How an order becomes binding

• Placing an order is an offer to buy; the contract forms when we confirm it
• We may decline or cancel an order — for example if a machine is out of stock, a price was listed in error, or delivery to your address isn't practical
• You'll get an email confirmation when an order is accepted
• Where we cancel an accepted order, we refund in full

Payment

• Payment is taken in full before dispatch
• Payment is processed by our payment provider; we don't store full card numbers
• Prices are in US dollars and exclude sales tax unless stated
• Sales tax is added where required by law

Pricing errors

If a machine is listed at an obviously incorrect price, we'll contact you before processing the order and you can confirm at the correct price or cancel for a full refund. We won't simply charge you the higher amount.

5. Shipping and delivery

Full detail is in our Shipping & Delivery Policy. In summary:

• Orders are processed within 1 business day
• Standard shipping within the United States is free
• Delivery times are estimates, not guarantees — carriers and weather intervene
• Large machines ship by pallet freight, which works differently from parcel delivery
• An adult must be present to receive and sign for a machine

Access and failed deliveries

You're responsible for telling us about anything that would prevent a delivery vehicle reaching your address. Where a delivery fails because nobody was available or access was not as described, any redelivery or storage charge levied by the carrier may be passed on at cost.

Risk and title

Risk passes to you on delivery. Title passes when payment has cleared in full.

6. Returns and refunds

Full detail is in our Refund & Return Policy. In summary:

• 30 days from delivery to return an unused machine
• We cover return shipping on US orders, and there's no restocking fee
• Contact us for authorisation before sending anything back
• Refunds go to the original payment method

7. Safe use of equipment

Mowers are machinery with exposed rotating blades. This section matters more than the rest of this document.

Your responsibilities

• Read the operator's manual before first use, and keep it
• Observe the slope limits in the manual for your model. Riding mowers and zero-turns can lose traction or roll on ground that a walk-behind handles safely
• Keep guards and safety devices in place. Blade-stop systems, discharge chutes and operator-presence controls exist for a reason and removing them is dangerous
• Clear the area of stones, wire and debris before mowing, and keep people and animals away while the machine is running
• Stop the engine and disconnect the spark plug before inspecting the blade or clearing a blockage
• Use appropriate protective equipment — eye protection and hearing protection at minimum

Modifications

Fitting non-standard parts, removing safety devices or altering the engine will void the manufacturer's warranty and may make the machine unsafe. We can't accept responsibility for a machine that has been modified.

8. Warranties and disclaimers

Manufacturer warranty

• Machines carry the manufacturer's warranty, and the terms are set by the manufacturer, not by us
• We register the engine warranty for you at the point of sale
• Warranty terms for the deck, transmission and other components vary by model — the operator's manual is definitive
• We help you make a claim, but the manufacturer decides it
• Warranty work is carried out by authorised service centres

What warranties don't cover

• Normal wear items: blades, belts, filters, plugs, tyres
• Damage from misuse, accident, neglect or lack of maintenance
• Damage from stale or contaminated fuel
• Machines that have been modified or fitted with non-standard parts
• Commercial use of a machine sold for residential use, where the manufacturer's terms exclude it

9. Limitation of liability

To the extent permitted by law:

• Our total liability in connection with any order is limited to the amount you paid for the goods concerned
• We are not liable for indirect or consequential losses, including lost income, lost contracts or the cost of hiring alternative equipment
• We are not liable for injury or damage arising from use of a machine contrary to the operator's manual, or from modification of the machine

Nothing in these terms limits liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited by law.

Events outside our control

We're not liable for delays caused by events beyond our reasonable control — severe weather, carrier disruption, manufacturer supply problems, industrial action or government restrictions. Where such an event occurs we'll tell you and, if the delay is substantial, you may cancel for a full refund.

10. Site conduct

Not permitted

• Fraudulent orders or payments
• Misrepresenting who you are or who you're buying for
• Attempting to interfere with, scrape or gain unauthorised access to the site
• Interfering with other people's use of the site

Reviews and submitted content

• Reviews must be honest and based on your own experience of a product you bought from us
• Don't post content that's unlawful, abusive, or infringes someone else's rights
• No advertising or promotional content without our agreement
• We may remove content that breaks these rules, and we won't remove a review just because it's critical

11. Intellectual property

Ours

The DeskDodes name, logo, site design, photography and written content are our property or used under licence. Don't copy or reuse them without permission.

Other people's

Toro, Craftsman, Briggs & Stratton, Kawasaki and other manufacturer names, model names and logos are the property of their respective owners. We use them to identify the products we sell. Nothing on this site implies any endorsement beyond our dealer relationship.

If you believe content on this site infringes your rights, contact us and we'll look into it.

12. Privacy

How we handle personal information is set out in our Privacy Policy, and our use of cookies in our Cookie Policy. Both form part of your agreement with us.

In short: we collect what we need to sell you a machine and support it afterwards, we don't sell your information, and you can ask us for a copy of what we hold.

13. Changes to these terms

• We may update these terms as our business or the law changes
• The revision date at the top of this page shows the current version
• The terms that apply to your order are the ones in force when you placed it — a later change doesn't alter an order already accepted
• Continued use of the site after an update means you accept the revised terms for future orders

14. Governing law

These terms are governed by the laws of the State of New York, without regard to its conflict of law rules.

Resolving disputes

• Talk to us first. Most disputes are a misunderstanding about delivery, warranty or returns, and a phone call settles them faster than anything else
• If we can't resolve it between us, the courts of the State of New York have jurisdiction
• Nothing here prevents you bringing a claim in small claims court
• Nothing here removes consumer rights you have under the law of your own state
